A Clarendon businessman who was accused of receiving stolen goods has been freed of the charge after the prosecution agreed with defence lawyer Dwight Reece that there was no proof that the businessman was actively in possession of the goods.
Everton Sinclair, 59, owner of the New Jacks City Entertainment Complex in May Pen, Clarendon, was freed in the Corporate Area Resident Magistrate's Court earlier this week. He appeared before Senior Resident Magistrate Lorna Shelly Williams
The allegations were that on February 25, 2012, Sinclair was charged with receiving stolen property after 1,671 bags of soap powder were found at his businessplace. The soap was stolen from a container in Kingston on February 21, 2012.
Reece in arguing that Sinclair should be freed pointed out that when the police went to the premises, Sinclair showed them a lease agreement. He said the area where the goods were found was not occupied by Sinclair as he had rented it to someone. He said Sinclair merely had a copy of the keys for the section because he was the landlord.
The prosecution conceded that it could not prove the charge against Sinclair that he was in possession of the goods and had the intention to commit the offence.
