Two brothers Dexter Dyer and Garone Dyer of Mocho, Clarendon, have been freed in the Clarendon Circuit Court of charges of illegal possession of firearm and robbery with aggravation.
It was alleged that the brothers armed with guns, held up occupants of a house in Mocho on August 1, 2014, and robbed them of household appliances.
They were arrested and charged on August 26.
Under cross-examination by attorney-at-law Dwight Reece, who represented the brothers, the witnesses admitted that the men who entered their house were masked.
When it was suggested to the witnesses that they did not mention anything about any masked men in their statements, they said they gave that information to the police.
The investigating officer said under cross-examination that the witnesses did not tell him that the men who robbed them were masked.
Reece suggested to the policeman that he deliberately left out the fact that the robbers were masked, but he denied the suggestion.
Following the revelation that the robbers were masked, Reece submitted yesterday that the identification evidence was unsatisfactory.
Justice Sarah Thompson James upheld the submissions and freed the men.
