Absence of witness causes postponement of murder case

The constant absence of a witness in a murder case has again resulted in the postponement of a preliminary inquiry for the ninth time in two years.


Wayne Green, 47-year-old painter, is charged with the murder of Alafia Carney, 38, of Sydenham, St Catherine.


The revelation was made on Friday when the matter was mentioned in the Spanish Town Resident Magistrate's Court. Investigating Officer Detective Constable Kevin Garnet told the court that his checks revealed that the main witness is overseas.


He told the court his checks also revealed that he is having immigration problems. Attorney-at-law Lancelot Clarke Jr said the matter is 30 months old and needs to proceed.


He asked that the matter be dismissed for want of prosecution.


Clerk of Court, Martin Chisholm, then informed Resident Magistrate Vaughn Smith that an application will be made to the director of public prosecutions for a writ of nolle prosequi.


Allegations are that on the day in question, the accused visited Carney's home. He was said to have made advances which were spurned by the woman. There was said to have been a physical encounter during which she was stabbed repeatedly, and died as a result. An investigation resulted in Green being charged with murder.


He has maintained his innocence throughout his court appearances.


The matter is scheduled to be heard again on March 24, 2015.
