WESTERN BUREAU:
Two St James men accused of robbing a couple who was having sex on a beach, were freed in the Montego Bay Resident Magistrate's Court Wednesday.
Vendor, David Hewin, 25, from Salt Spring and Richard Denny, a labourer of Dome Street, Montego Bay, were previously charged with robbery with aggravation, but freed of the charge due to the failure of the witnesses to appear before the court.

Allegations were that on July 17, 2013, approximately 9:30 p.m., the complainants were having an intimate moment at the popular Dump-up Beach in Montego Bay, when they were approached by three men armed with knives. Two cellular phones and a purse were taken from them.
Shortly after, the couple made a report to nearby police officers, who held Hewin and Denny. They were subsequently charged.
Clerk of the court, Sheryl Robinson, told presiding magistrate Wilson Smith, that none of the prosecution witnesses, including the complainants and the investigating officer, were at court.
"The investigating officer is not here, (also), one of the complainants has not been coming to court," said Robinson.
RM Smith subsequently dismissed the case, but not before giving Hewin and Denny a stern warning.
"I do not know if you are innocent or guilty, but if you need to change your lives, please do so," he told them. "Because we are not getting the support we need, this matter is dismissed for want of prosecution."
