Rutty was sentenced to nine months in prison for the offence.
After Senior Resident Magistrate Judith Pusey handed down Rutty's sentence, the complainant, who is currently in custody on murder charges, pleaded with the judge to drop the charges, stating that his life was in danger.
"I don't want to press any charges because my life is in danger and it will spread in the jail that I am an informer."
